All private transfer/sales require a background check.  A firearms dealer may perform the background check for a private transfer and may only charge up to $10 to conduct the background check.  The only exceptions to private transfer are transfer between spouses, domestic partners, children, and step-children.

Personal Sales Background Checks are needed for all private sales/cross referencing of firearms in New York State (both handgun and long gun).

Cost is $75 per rifle/shotgun/lower and $100 per handgun in the same shipment. A $9.00 NYS background check fee will be added to this transfer.

The following is what is needed to process the background check:

Sale of a handgun/revolver:

  • NYS Drivers License  (from both the buyer and the seller)
  • NYS Pistol Permit Number, Date of Issue, Issuing Judge, County of Issue (from both the buyer and the seller)
  • Amendment from your County of Issue (from both the buyer and the seller) 
  • Address and phone number (from both the buyer and the seller)
  • Gun information including Make, Model, Serial #, action type, revolver or pistol, caliber, barrel length
  • In Westchester County we MUST be holding the handgun/revolver prior to the buyer picking up the firearm. There will be a fee of $1.50/per/day per handgun.


Sale of a long gun (rifle or shotgun):

  • NYS Drivers License  (from both the buyer and the seller)
  • Address and phone number (from both the buyer and the seller)
  • Gun information including Make, Model, Serial #, action type, caliber, barrel length
    If you are transferring a semi-automatic rifle, the transferee (Purchaser) must have a Semi-Automatic Rifle Permit or a Semi-Automatic Rifle Endorsement on their pistol permit.

Only the purchaser of the gun needs to have a background check done. 

If you have a receipt of sale, please bring that with you.

Your handgun MUST stay with us while you wait for the amendment from your county, the fee is $1.50/per/day per handgun. See FFL Service Fees
